Birmingham Partner Craig Alexander Wins Appeal Before Alabama Supreme Court
RumbergerKirk attorney Craig A. Alexander successfully prosecuted the appeal to the Alabama Supreme Court from an order from the Disciplinary Board of the Alabama State Bar disbarring a Birmingham, Alabama attorney. In a unanimous opinion issued on October 8, 2010, the Court reversed the board’s determination that the attorney was guilty of violating Rule 1.8(c) of the Alabama Rules of Professional Conduct, and as to four other misconduct charges, the court remanded the case to the board with the direction to to issue an order that complied with the Alabama Rules of Disciplinary Procedure. In a case of first impression, the court also held that the attorneys involved in disciplinary proceedings were permitted to file motions for new trial, and but declined to decide whether the board erred in denying the attorney’s motion for new trial and instead allowed the board to reconsider its denial of this motion on remand.
Alexander handled the representation of the attorney after the disbarment order had been entered. He handled both the preparation of the briefs and the oral argument before the Supreme Court of Alabama.
