How Miami Attorneys Blocked a $1.9M Suit From a Lawyer Who Fell From a Ladder, Daily Business Review
In an article published by the Daily Business Review on March 30, 2020, Scott Sarason and Jens Ruiz discuss their defense win for Louisville Ladder and the power of defending a product liability claim based on the design, rather than contesting a plaintiff’s injuries in the federal lawsuit. In February, a jury deliberated for about 45 minutes before returning a verdict that the company was not negligent and that its stairs were not defective or lacking warnings.
Sarason explained the case meant a lot to the company and its reputation.
“If this was a design defect and there were 800,000 units being used, even it was as much as twice a year over those 30 years, you wouldn’t have hundreds of thousands of millions of times where the ladder’s being used where nobody got hurt,” Sarason said. “Louisville Ladder believes in its product. We believe it is safe and we believe that this was an unfortunate accident.”
