The administration has said an extension is necessary to deliver more of the aid that arguably should have already been provided. The administration could appeal an existing district court order to immediately enforce an end to the moratorium, “but because the Supreme Court has already ruled that the necessary congressional authorization is lacking, those appeals would almost certainly be futile,” explains Spence.
