Mastering the Art of Negotiation: Insights from RumbergerKirk’s Associate College

During this month’s Associate College luncheon, Dan Gerber and Rebecca Beers shared insights on Negotiation Strategies. Orlando associate Madison Buckley took notes.

  • When developing your negotiation strategy, you should always know the client’s best possible outcome, the worst-case scenario, and an acceptable middle ground. This will help you understand your client’s priorities and core concerns so you can effectively guide the negotiations.
  • Always do your homework. From negotiating discovery to drafting settlement agreements, you need to know the law, facts, and risks to advocate and back up your position effectively.
  • Identify flexibility and firmness by determining what you might be willing to give on, and where you will draw a hard line. This will streamline the negotiation process, reducing unnecessary back and forth while achieving your goals.
