RK Partner David Willis Presents to the Associated General Contractors
On May 13, 2008, David C. Willis, who is Board Certified in Business Litigation and Construction Law, conducted an interactive seminar on the newly released AIA and Concensus DOCS Construction Contracts for members of the Associated General Contractors of Greater Florida. The AIA documents are amended every ten (10)years and have been the industry standard for many years. On the other hand, the ConcensusDOCS are a new "standard" contract created by numerous organizations representing the various tiers of contractors, owners and design professionals.
David’s presentation focused on the AIA A201 and ConcensusDOCS 200 contracts between an Owner and a General Contractor. Specifically, David analyzed and presented the changes and ramifications of the indemnity and dispute resolution provisions from the perspective of the Owner, General Contractor, and Architect for a given project. Both the AIA and the ConcensusDOCS present varying areas of concern and promise for all parties who may be negotiating and executing construction contracts in the future. While the ultimate pros and cons of these versions of the "standard" constructions contracts are yet to be determined, the seminar was insightful for those contractors, owners and design professionals who have yet to have the opportunity to negotiate or enter into these amended agreements.
