Rob Blank and Carie Hall Win Appeal Before Fifth DCA of Florida
Glenda Torres Perez v. Sea World of Florida LLC, Case No. 5D18-130 (Fla. 5th DCA April 30, 2019)
Attorneys Rob Blank and Carie Hall from the firm’s Tampa office won the appeal of this case before the Fifth District Court of Appeal of Florida. Without a written opinion, the three appellate judges agreed with the appellate arguments made by Blank and Hall, unanimously affirming the trial court’s denial of Plaintiff’s Motion for New trial. The appellate court granted Sea World’s motion for appellate attorney’s fees. On October 27, 2017, Blank and Hall obtained a defense verdict in a negligence case in Orange County, Florida, representing the Sea World park located in Orlando, Florida. Plaintiff claimed she fractured her ankle and injured her back going down the stairs in the Manta rollercoaster queue line. Blank and Hall proved there was no defect in the stairs, no problem with the lighting in the staircase and nothing wrong with the procedures for operating the queue at Manta. The jury found no negligence, returning a verdict in Sea World’s favor. The trial court granted Sea World’s motion for trial attorneys’ fees and costs.
