After four days of trial, the jury entered a quick defense verdict in the case of Nicole Jacobs v. Raving Fans Restaurant Group d/b/a Moe’s Southwest Grill.
The plaintiff claimed she slipped on a wet floor that she attributed to an employee mopping the floor. She sought recovery for injuries to her neck and back incurring over $650,000 in past medical expenses and claiming more than $1.3 million in future medical expenses. During his closing argument, plaintiff’s counsel asked the jury to award over $4 million. The trial team argued the employee properly placed a wet floor sign in plain view and that plaintiff did not see or appreciate the sign because she was distracted by use of her cellphone. The jury accepted the defense position that the warning sign was open and obvious, returning a verdict for the defense within 30 minutes.
